ERISA, benefits, and executive compensation counsel face complex ethical issues in representing various companies, administrators, and fiduciaries. Factors such as the dual roles and interlocks that characterize the practice pose distinct ethical challenges for attorneys.
Key ethical concerns include conflicts of interest, especially when representing multiple parties, and communications with outside or in-house counsel, and fiduciaries. Other significant ethical issues include duties of loyalty and confidentiality and attorney-client privilege.
