Introduction
This CLE course will provide counsel with guidance on the legal issues concerning online businesses addressing concerns that arise from compliance with privacy requirements in addition to directing companies on matters related to domain acquisition, theft, and squatting. The panel will direct corporate attorneys on managing fraud and securing e-commerce transactions.
Description
The demise of brick and mortar businesses has conversely seen the rise of online companies providing both goods and services. With the growing establishment of e-commerce, counsel must prepare to advise companies operating or maintaining a website on unforeseen legal liabilities.
The foundation governing structure for any website or online concern will be robust terms and conditions. This agreement creates contractual terms between the company and the customer. Corporate counsel will need to be prepared to address both general issues of compliance with national and international privacy laws, as well as set forth the terms of governance, dispute resolution processing, and any limitations on liability in addition to other issues.
Beyond the creation and maintenance of proper terms and conditions, counsel must be prepared to advise online companies of issues that arise regarding acquiring and protecting their domain and similar IP disputes which may arise. Entrepreneurs will need assistance navigating the legal issues associated with social media and how to properly promote their companies within legal restrictions and transparency requirements. Finally, both startups and legacy online commerce clients require advice on traversing the complicated world of tax collection and submission of sales taxes.
